What is Availability Error?

Alternative Forms: Availability bias
Legal Definition
Availability Bias (also called availability error) is figuring out probabilities from the first thing that pops into your head. It’s called availability bias because of the distorted (biased) results that these types of calculations produce. It’s also sometimes called the availability heuristic, where heuristic means a “rule of thumb.” Unlike statistically sound probability calculations, availability bias accounts to nothing more than a quick guesstimate.
Legal Definition
Availability error, related to the gambler's fallacy, is the distortion of one's perceptions of reality due to the tendency to remember one alternative outcome of a situation much more easily than another.
